EU Responsible Person — Your Gateway to the European Cosmetics Market

Non-EU manufacturers must appoint an EU Responsible Person before a single product reaches an EU market. UK brands are now non-EU manufacturers.

Under Regulation (EC) No 1223/2009, every cosmetic product sold in the EU must have a Responsible Person established within the European Union. This entity is legally responsible for ensuring the product’s compliance with EU cosmetics regulation across all member states.

Prior to Brexit, UK-based companies could act as their own EU Responsible Person. Since January 2021, UK brands must appoint an EU RP to access the EU market. Without an EU Responsible Person, products do not meet the legal requirements for placement on the EU market.

What the EU Responsible Person Is Responsible For

The Responsible Person is responsible for ensuring that, CPNP notification is completed before the product is placed on the EU market, the Product Information File is held at an EU address and made available to competent authorities on request, a compliant and up-to-date CPSR is in place, appropriate post-market surveillance is carried out, including the monitoring and reporting of serious undesirable effects, product labelling meets EU regulatory requirements, cooperating with competent authority investigations, appropriate corrective actions, including product withdrawal or recall where necessary, are carried out
